In addition, using products such as algaecides and shocks --even with an EPA registration-- for anything other than it's intended purpose, is a violation of the EPA FIFRA regulations.

Our Properties are provided from the United States of America and all servers that make it available reside in the U.S.A and its possessions. PRODUCT INFORMATION AND AVAILABILITY

Bromitron reserves the right at our sole discretion to change, alter, discontinue, or remove products, product descriptions, and pricing on BROMIcharge.com at any time. Bromitron shall have no liability of any kind if a product that has been ordered is unavailable. We shall not be liable for failure to perform caused by a circumstance or event beyond its reasonable control including, without limit, strikes or industrial disputes (whether involving Bromitron's workforce or that of a third party), shortages of or inadequate sources of raw materials, component parts or essential utilities.

PRICING

BROMIcharge is 99% pure sodium bromide (NaBr) from the Dead Sea. Its price may fluctuate depending upon market availability or other circumstances beyond our control, and although we do our very best to keep our prices as low as possible for our customers, price increases may occur without notice and at our sole discretion. Bromitron disclaims any liability for damages or losses relating to any loss of profits or loss of commission as a result of business transactions not concluded due to price increases.

The prices charged on the Website will be those in effect on the date of receipt of your order. Bromitron reserves the right to correct any errors or mistakes in pricing that it makes even if it has already requested payment. Bromitron disclaims any liability for damages or losses relating to any loss of profits or loss of commission as a result of business transactions not concluded due to price increases.

ORDERS

Acknowledgment of your order means that your order request has been received. It does not mean that your order has been accepted or shipped or that the price or availability of an item has been confirmed. You agree to accept responsibility for all purchases and other activities that occur under your name and/or from your IP address.

BILLING

Only major credit cards are eligible for billing, and We reserve the right to reject debit cards, gift cards, pre-loaded cards or similar billing devices. All registration and billing information provided by you must be complete and accurate. Submitting incomplete or inaccurate information constitutes a breach of these terms. By confirming your purchase at the end of the checkout process, you agree to pay for and accept the items or products which you have ordered. We are not responsible should you give incorrect order instructions or if your credit/debit payment is not processed by your credit card company.

Bromitron reserves the right to refuse any order placed online at BROMIcharge.com. In the event that an order is cancelled, we will attempt to notify you by contacting the e-mail address and/or phone number provided at the time the order was made. NOTICE: Billing name will appear on your bank or card statement as: REALITY GROUP, INC.

You agree to pay Reality Group, Inc for all charges at the prices then in effect for the products and/or services you or other persons using your account or payment method may purchase, and you authorize Reality Group, Inc or its designated payment processor to charge your payment provider for any such purchases. All payments are to be made in United States Dollars. Posted prices do not include sales tax, which will be charged to you when applicable.

CREDIT CARD DISPUTE ABUSE POLICY

All instances of chargeback abuse will be reported as delinquent accounts for collection. This action will also be reported to major credit bureaus, and may be part of a consumer's credit file for 7 years. We also reserve the right to file a police report for credit card fraud, and seek criminal prosecution, along with a report to the FBI Internet Crimes division, as appropriate. We further reserve the right to report the incident for inclusion in a chargeback abuser database.

RETURNS AND REFUNDS

In order to return an item to BROMIcharge.com you must contact us by calling 1-877-BROMINE or emailing us at BROMIcharge@gmail.com to obtain approval. Returns without prior approval cannot and will not be accepted. Bromitron does not take responsibility for returned items or products until they arrive and are received by our headquarters and will not be held responsible for any damage incurred during return shipping. In order to receive credit, the merchandise must be in its original, salable condition.

Refunds from BROMIcharge.com will be credited to your account immediately upon receipt of the returned items or products, although your financial institution may place a hold on these funds. If you have received a refund from BROMIcharge.com but do not see the funds in your account, please contact your financial institution. We are not responsible for any holding of funds by your financial institution.

RISK OF LOSS

All items purchased from our Properties are made pursuant to a shipment contract. Unless otherwise set forth, the risk of loss and title for such items pass to you when we deliver the items to the shipping carrier. You are responsible for filing any claims with carriers for damaged and/or lost shipments.

COMPLIANCE WITH LAWS

It is your responsibility to ascertain and obey all applicable local, state, federal, and international laws (including minimum age requirements) in regard to the receipt, possession, use, and sale of any item purchased on the Properties. By placing your order, you represent that the products ordered will be used only in a lawful manner.

INDEMNIFICATION

By using the Properties, you agree to defend, indemnify, and hold harmless Bromitron and its respective affiliates, employees, directors, officers, agents, vendors, and suppliers (“Bromitron Indemnified Parties”) from and against any losses, liabilities, investigations, claims, suits, damages, costs, and expenses, including, without limitation reasonable attorneys’ fees and expenses, made against any of the Bromitron Indemnified Parties by any third party due to or arising out of or in connection of your violation of these Terms or any activity related to your transactions and/or account (including negligent or wrongful conduct) by you or any person accessing our Properties using your account and/or IP Address. You agree to fully cooperate with Bromitron in the defense of any claim. Bromitron reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You will not in any event negotiate or settle any claim without the prior written consent of a duly authorized employee of Bromitron.

LIMITATION OF LIABILITY

IN NO EVENT SHALL BROMITRON OR ITS RESPECTIVE AFFILIATES, OR DIRECTORS, OFFICERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, OR REPRESENTATIVES OF ANY OF THE FOREGOING, BE LIABLE TO YOU OR ANY THIRD PARTY FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, ATTORNEYS’ FEES, OR DAMAGES FOR LOSS OF PROFITS, GOODWILL OR REVENUE, BUSINESS INTERRUPTION, OR LOSS OF DATA) ARISING OUT OF OR IN CONNECTION WITH THE USE OF, ACCESS TO, RELIANCE ON, UNAVAILABILITY OF, INABILITY TO USE, OR IMPROPER USE OF BROMITRON PROPERTIES, INCLUDING, BUT NOT LIMITED TO, ANY INFORMATION, PRODUCTS, AND/OR SERVICES OR THE DISCLOSURE OR MISUSE OF ANY OF YOUR PERSONAL INFORMATION, EVEN IF WE HAVE BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, AND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), BREACH OF WARRANTY, PRODUCT LIABILITY OR OTHERWISE.

IF YOU ARE DISSATISFIED WITH THE PROPERTIES, ANY CONTENT ON THE PROPERTIES, OR THESE TERMS, AS MAY BE AMENDED FROM TIME TO TIME, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE. THIS LIMITATION SHALL APPLY NOTWITHSTANDING ANY FAILURE OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDY PROVIDED HEREIN.

IF ANY PART OF THESE LIMITATIONS OF LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON OR IF WE ARE OTHERWISE FOUND TO BE LIABLE TO YOU IN ANY MANNER, THEN OUR AGGREGATE LIABILITY FOR ALL CLAIMS UNDER SUCH CIRCUMSTANCES FOR LIABILITIES SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR PURCHASES MADE ON THE PROPERTIES.

IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES, IN PART: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.”

EXCLUSIONS

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

GOVERNING LAW

Bromitron corporate headquarters is located in Orlando, Florida. These Terms are governed by and shall be construed in accordance with the laws of the State of Florida, without regard to any conflict of law principles. Any action or proceeding arising out of or related to these Terms must be brought in the state or federal courts of Florida. You hereby consent to the exclusive personal jurisdiction of such courts and waive any objection based on forum non conveniens.

CLASS ACTION WAIVER

YOU AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTION WITH THE PROPERTIES AND THESE TERMS WILL BE RESOLVED INDIVIDUALLY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING IN THE FORUM DESIGNATED ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.

ANY CLAIM YOU HAVE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE DATE OF THE CLAIM.

The provisions of these Terms shall survive any discontinuation of the Bromitron Properties. No course of conduct or trade practice will modify these Terms. In the event that any provision of these Terms conflicts with the law under which these Terms are to be construed or if any such provision is held invalid by a court with the necessary powers, such provision shall be deemed to be restated to reflect as nearly as possible the original intentions of Bromitron, and the remainder of these Terms shall remain in full force and effect. No failure to exercise, partial exercise of, or delay in exercising any right or remedy under these Terms shall operate as a waiver or estoppel of any right, remedy, or condition. You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without Bromitron’s express prior written consent. In our sole discretion, Bromitron may assign, transfer, or sublicense any of our rights or obligations under these Terms, in whole or in part, without notice to you. The headings used in these Terms are only for convenience and are to be given no legal or contractual meaning or effect. These Terms include and incorporate by reference Bromitron’s Privacy Policy and all other policies made available to you by Bromitron on its Properties.

MODIFICATION AND TERMINATION

Bromitron reserves the right, at its sole discretion, to make changes to our Properties, policies, and these Terms at any time. Updated Terms will be posted on our Properties and will be immediately effective once they are posted. These Terms were last updated as of the date provided above.
